Terms for using Naya Growth websites, app workspaces, services, integrations, WhatsApp workflows, and billing flows.

Introduction

These Terms of Service govern use of Naya Growth websites, app workspaces, client portals, productized services, connected integrations, and related communication workflows.

Who may use Naya Growth

Naya Growth is intended for businesses, founders, operators, agencies, and authorized client users. You must provide accurate information and use the platform only for lawful business purposes.

Website usage

Submitting a website enquiry or contact form does not create a binding service engagement. Any engagement depends on written scope, quote/SOW terms, and acceptance.

App workspace usage

Client workspaces may include projects, lead intake, LeadDesk workflows, billing, documents, WhatsApp readiness, source connections, and delivery visibility. You are responsible for maintaining account security and limiting access to authorized users.

Service packages, payments, invoices, refunds, and cancellations

Service scopes, timelines, payment terms, included revisions, launch responsibilities, and deliverables are governed by the applicable package, quotation, statement of work, invoice, or written agreement.

Refunds, cancellations, and failed or duplicate payments are handled under the applicable commercial terms and the public refund policy where relevant.

Client-provided content and assets

Clients are responsible for the accuracy, legality, ownership, and permission status of materials, content, customer lists, leads, phone numbers, brand assets, claims, testimonials, and data supplied to Naya Growth.

Third-party platforms and integrations

Naya Growth may connect with third-party platforms including Meta, WhatsApp, Google, Cashfree, Notion, email providers, analytics providers, CRM systems, automation tools, and hosting providers. Those platforms are governed by their own terms, policies, limits, review decisions, and availability.

WhatsApp Business Platform usage

Clients using WhatsApp, Meta, email, advertising, CRM, or other connected workflows through Naya Growth must comply with all applicable laws, Meta Platform Terms, WhatsApp Business Messaging Policy, template rules, opt-in requirements, and anti-spam obligations.

Naya Growth may block, pause, restrict, or disable messaging, automation, or integrations if we believe a workspace may be causing spam, unauthorized outreach, platform violations, fraud, abuse, excessive failures, opt-out non-compliance, or unsafe automation.

Prohibited use

You may not use Naya Growth for unlawful outreach, spam, fraud, deceptive claims, harassment, scraping without rights, platform policy evasion, abuse of automation, unauthorized access, or activity that damages Naya Growth, clients, recipients, or third-party platforms.

Service availability and outcomes

We work to keep services reliable, but third-party platforms, hosting providers, payment providers, messaging providers, and internet services may fail or change. Naya Growth does not guarantee specific revenue, lead volume, ad performance, WhatsApp approvals, or green tick verification.

Data, privacy, confidentiality, and intellectual property

Privacy handling is described in our Privacy Policy. Client confidential information is handled for service delivery and support. Naya Growth retains ownership of its pre-existing frameworks, internal tools, methods, software, and reusable infrastructure unless a written agreement states otherwise.

Limitation of liability, indemnity, and termination

To the fullest extent permitted by law, Naya Growth is not liable for indirect, incidental, special, consequential, or lost-profit damages. Clients agree to indemnify Naya Growth for claims arising from client-provided data, unlawful messaging, content, approvals, or misuse of the platform. We may suspend or terminate access where required for safety, non-payment, breach, or platform risk.

Governing law and contact
